Designs

Have you designed something new? Whatever your new design, it may be possible for you to obtain the exclusive right to it by seeking registration of the design.

Creative designs are a form of intellectual property belonging to their creator. If you have created something such as a new look for a product, clothes or a design that can go on clothes, jewellery etc, this may be something you have the exclusive rights to. Registering a design is an important part of protecting those rights.

The design that you have created must be new when the registration application is filed, and must not already exist in any product on the market.

For that reason, you should make sure that you register your design before public disclosure in order to give your work the best protection achievable.

Our attorneys can:

  • Research potential conflicting rights, and advise our clients on them.
  • Prepare and file applications in Ireland, the UK, Europe, and around the world.

  • Provide legal advice on issues with infringement, cancellations, or ratification proceedings where needed.

Industrial design protection is also available internationally based on an initial Irish or EU application.

BUT to secure this, an application must be made within six months of filing the original application in Ireland or the EU.
